Legal professional privilege.  The first and second defendants/cross-claimants sought access to documents which the law firm acting for tenth cross-defendant had ‘produced on subpoena’.  The tenth cross-defendant claimed legal professional privilege in respect of certain documents.  One disputed the document in respect of a claim of privilege.  It was considered whether the cross-defendant had waived privilege over ‘some or all’ documents  pursuant to s122 Evidence Act 1995 (NSW).  It was held that a  ruling was to be made on disputed document.  It was implied there was a waiver established with respect to certain documents and orders were made.
